For Indian sales, marketing and operations teams using calls, WhatsApp and AI-assisted lead follow-ups.
The TRAI 7 day enquiry rule allows commercial communication arising from a qualifying customer enquiry for seven days from the enquiry date, subject to the regulatory conditions. It is not permission to call any lead repeatedly or send unrelated promotions.
Under TRAI's September 2026 amendment, the customer enquiry must be written or digital and retained in verifiable form. The original request, contact purpose and audit trail therefore matter. This guide explains the TRAI 7 day enquiry rule, separates phone and WhatsApp requirements, and includes a practical planner within the article.
The Ministry of Communications' announcement of 18 September 2026 says commercial communications based on an enquiry made by a customer to a sender for goods, products or services are permitted only for seven days from the date of that enquiry. The enquiry must be recorded in writing or digitally and remain verifiable. It mainly targets e-commerce and e-service platforms.
Three things follow. First, a qualifying customer request matters more than an imported lead list. Second, the enquiry date determines the relevant window; an unanswered follow-up does not reset it. Third, the TRAI 7 day enquiry rule is one limited provision within broader telecom rules, not a replacement for consent and customer-preference requirements.
Question | Practical answer |
| What establishes the window? | A qualifying written or digital enquiry to the sender |
| When does it begin? | From the date the customer made that enquiry |
| How long is it? | Seven days, subject to the actual regulatory conditions |
| Is an imported contact list enough? | No, importing numbers is not itself a customer enquiry |
| Can every lead receive seven calls? | No such blanket entitlement follows from the rule |
| Does the same window authorise WhatsApp marketing? | No, separate WhatsApp policy and legal requirements apply |
TRAI published a Fourth Amendment on 4 November 2026 addressing commencement of Regulation 35A. Check rules and provider requirements before launching. The TRAI amendment register lists the governing documents.
The enquiry must come from the customer to the sender. A CRM contact alone does not establish it.
Examples:
Imported lists are not customer-initiated enquiries.
For TRAI lead follow-up consent assessment, retain the timestamp, enquiry form, requested service, consent wording and withdrawal records. This is a suggested checklist, not a statutory field list.
A call's purpose matters. The TRAI 7 day enquiry rule should not be used to relabel promotional outreach as a response to an enquiry.
Type | Example | Review before sending |
| Enquiry follow-up | Answer a requested course-fee question | Does the content match the documented request and applicable window? |
| Service communication | Update an existing customer about a service | Which service-communication provision applies? |
| Promotional communication | Offer an unrelated new product | Are promotional permissions and preferences satisfied? |
| Transactional communication | Send transaction-related information | Is it correctly classified under the regulations? |
One course enquiry does not authorise unrelated campaigns. Separate seven-day provisions concern certain service consents and unsolicited-communication complaints. For telemarketing consent India workflows, classification should be checked before automation, not after complaints.
No. The TRAI 7 day enquiry rule does not waive every other condition applying to a communication. A business should confirm that the enquiry qualifies, the message stays within its purpose, any other applicable permission exists, and no relevant opt-out has been received.
For voice calls, check provider procedures and customer preferences. Do not assume that a missed call, CRM update or agent-generated reminder gives the business a fresh seven-day period.
WhatsApp lead follow-up compliance is a separate check. Under the WhatsApp Business Messaging Policy, businesses need appropriate opt-in to contact people; must honour opt-outs; and, on the Business Platform, must use an approved template to initiate a conversation. A free-form reply is allowed during the 24-hour customer-service window following a user message. Outside it, an approved template is required. Automated service must offer a clear escalation path.
The WhatsApp 24-hour window is not TRAI's seven-day period. A phone callback request is not automatic WhatsApp marketing consent.
Use the seven-day table below as a permission-review framework, not a seven-call sequence. No row automatically authorises outreach.
Day | Channel and purpose | Consent / permission check | Owner / next action |
| 1 | Call: respond to enquiry, if permitted | Verify written/digital evidence and purpose | Sales owner records outcome |
| 2 | WhatsApp: requested details, if permitted | Recheck channel permission; WhatsApp template if applicable | Agent updates record |
| 3 | Internal: review, no outreach | Check replies and preferences | Manager assigns next step |
| 4 | Call: unresolved question, if permitted | Revalidate basis and contact history | Owner logs result |
| 5 | Internal: lead review | Check opt-outs and repeat-contact risk | Team lead approves or stops |
| 6 | Permitted channel: requested response only | Confirm purpose and remaining basis | Owner documents decision |
| 7 | Internal: expiry review | Check expiry and any independent lawful basis | Close, suppress or reclassify |
Illustrative operational schedule, not legal approval of any particular day, time, channel or frequency.
How to use this table: For each lead, record the enquiry date and source, exact consent status (verified, missing, withdrawn or not applicable), channel, follow-up purpose, assigned person, next action and communication log. The owner should check permission before any contact, then mark STOP if consent is withdrawn, the enquiry basis expires, the customer opts out or the proposed message exceeds the original purpose. An internal review day does not mean a call must occur. The schedule requires legal approval before use.
For the TRAI 7 day enquiry rule, the original enquiry by itself should not be relied on to justify contact beyond its applicable window. Further outreach needs a separately established valid basis, not an assumed extension because the prospect did not respond.
Apply stop-contact checks before every proposed call or message:
Reflect opt-outs in calling, WhatsApp and human-sales queues. Record the reason and owner. A new message does not authorise unrelated marketing.
The September 2026 amendment separately addresses application-to-person (A2P) calls, including voice calls initiated by software or automated systems without direct human dialling. The official ministry announcement describes prior declaration of A2P use and relevant calling-line identifiers to telecom service providers; undeclared calls are treated as unsolicited commercial communication under that framework.
For AI calling, review the telecom provider, numbers, A2P declaration, purpose, permissions and suppression process. Regulation 35A's commencement was addressed in the November amendment; do not assume every related charge provision has commenced merely because it appears in the September announcement.
The TRAI 7 day enquiry rule and A2P obligations answer different questions: may we contact this customer for this purpose? and are we using automated calling under the applicable telecom requirements? Both deserve a documented review.
The TRAI 7 day enquiry rule is especially relevant to businesses automating admission enquiries, test-drive requests and other inbound leads. Sicada.ai describes AI agents across calls, WhatsApp and chat, including lead qualification and CRM updates. Its AI Voice Agent product page describes call summaries, education lead qualification, CRM-connected records, voice-to-WhatsApp follow-ups and human handover.
An illustrative admissions workflow could be: capture enquiry → review permission → route an authorised call → document outcome → hand over complex questions → reassess next contact. This illustrative workflow does not establish that Sicada.ai automatically enforces consent expiry, DND checks or cross-channel suppression. Confirm those controls with the product and telecom teams before claiming them in a deployment.
Preventing mistakes matters more than increasing calls.
The September 2026 amendment describes a seven-day period for commercial communication based on a qualifying written or digital customer enquiry. That is not permission for unlimited calls. Each proposed communication must still satisfy applicable conditions and preferences.
The TRAI 7 day enquiry rule does not itself establish WhatsApp opt-in. Check the WhatsApp Business Messaging Policy and applicable law separately, including template rules and opt-outs.
Do not rely on the original seven-day enquiry basis alone. Another independently valid permission or regulatory basis would need to be established and documented.
No. Automating dialling does not remove underlying communication requirements. A2P provisions can add separate telecom obligations.
The TRAI 7 day enquiry rule offers a defined way to assess communications arising from genuine customer enquiries, not an open-ended marketing licence. For businesses, the practical work is to record the request, classify the intended communication, verify channel permission, assign ownership and stop outreach when the basis no longer applies.
Use the planner as a decision record rather than an automatic seven-day campaign. For AI-assisted follow-up, book a demo with Sicada.ai to discuss the supported voice, WhatsApp and CRM workflows, then have the proposed compliance controls reviewed before launch.
This guide is general information, not legal advice. A qualified Indian telecom-compliance professional should review the operative Gazette wording, commencement dates, provider requirements and proposed contact timings before publication or deployment.
